The prosecution will not make the murder trial of Economics professor Rafael Robb a capital case, meaning the death penalty will not be an option in sentencing, Montgomery County District Attorney Bruce Castor told The Associated Press last week.
Prosecutors decided not to seek the death penalty because they have not found aggravating circumstances that would make that sentence appropriate.
Castor's comments come after Robb waived formal arraignment last Wednesday and pled not guilty to murder and other charges relating to the Dec. 22 death of his wife, Ellen Robb.
Ellen Robb, who was 49 at the time, was fatally bludgeoned to death in her Wayne, Pa., home.
The couple had been estranged and were reportedly seeking a divorce at the time of the murder.
Penn has placed Robb on indefinite leave. He remains in custody.
